Terms of Service
Terms for TOEFLScorer practice, subscriptions, and the Prep Pass

1. Acceptance and operator
TOEFLScorer (the “Service”), available at https://toeflscorer.com, is operated by Enzo, an individual operator (“we,” “us,” or “our”). By using the Service or purchasing access, you agree to these Terms and our Privacy Policy. If acting for an organization, you confirm that you may bind it to these Terms.
The Service is for users aged 13 or older, or the higher minimum age required where they live. Users below the age of legal majority must have a parent or guardian's permission. You must be at least 18 and legally able to enter a contract to purchase; a parent or guardian must make purchases for a minor.
2. Practice service and AI scoring
We provide original TOEFL iBT practice in the 2026 format, including reading, listening, speaking, writing, automated score estimates, feedback, and practice history. TOEFLScorer is independent and is not affiliated with or endorsed by ETS. TOEFL and TOEFL iBT are trademarks of ETS. Our materials and scores are study aids, not official examination questions, official scores, or guarantees of admission or future performance.
Speaking evaluation uses the Zhiyan speech evaluation engine. Written responses are evaluated through Speko Router using third-party AI models. Availability and results can be affected by these services, recording quality, and your device or connection. AI feedback can be inaccurate or incomplete; review it before relying on it. We do not promise any particular score improvement.
Paid access is a digital service activated after payment confirmation. When checkout is unavailable or a plan is marked “Coming soon,” prices are previews and joining the waitlist does not create a purchase, subscription, or payment obligation.
3. Accounts and free access
Provide accurate account information, keep your credentials private, and report suspected unauthorized access to support@toeflscorer.com. Do not share or resell accounts. Keep your billing email current.
Test 1 is available without registration; detailed feedback requires a verified account. Outside the first full Test 1, the free scoring allowance is 11 speaking scores and 1 writing evaluation per UTC day. Anonymous usage is associated with the browser. Clearing browser storage can remove progress and does not authorize bypassing usage limits.
4. Paid plans
Current plans are described on the pricing page. Prices below are in US dollars; applicable taxes and the final total are shown before payment.

Paid plans include all available full-length and section practices, detailed feedback, and up to 300 speaking scores and 30 writing evaluations per UTC day. Daily allowances reset at 00:00 UTC, do not roll over, and are not cash or transferable credits. This is not unlimited scoring or a separately purchased credit balance. Prep Pass access expires at the end of its 75-day term.
The plan and price displayed at checkout govern your purchase. Material changes to an existing subscription's price or included access will be communicated at least 14 days before taking effect and apply to a subsequent renewal, giving you an opportunity to cancel. A purchased Prep Pass keeps its purchased term and benefits unless a change is legally required.
5. Payment and recurring authorization
Waffo Pancake acts as merchant of record for purchases and handles hosted checkout, payment processing, applicable tax handling, receipts, and refunds. Payment-card information is handled by Waffo Pancake's PCI-DSS-compliant payment infrastructure; complete card details do not pass through or remain on our servers.
By confirming Sprint or Monthly at checkout, you authorize Waffo Pancake to charge the displayed amount and applicable taxes now and at each weekly or monthly renewal until you cancel. By purchasing Prep Pass, you authorize only the displayed one-time charge. We do not offer automatic credit top-ups. A free practice session or waitlist registration does not automatically convert into a paid plan.
Failed payments may interrupt paid access. Your receipt identifies your transaction and payment details; contact us if you do not recognize a charge.
6. Canceling a subscription
Sign in, open Settings → Billing, and use the billing management button to open Waffo Pancake's customer portal and cancel your subscription online. The portal may require verification through your billing email. You can also contact support@toeflscorer.com from your registered email for help, especially if the portal is unavailable.
Cancel before the next renewal to stop future charges. A successfully recorded cancellation stops subsequent renewals; paid access remains available through the already-paid billing period. Cancellation alone does not refund that period. Check the cancellation status in your billing page or portal. Prep Pass does not need cancellation because it does not renew.
Canceling a subscription does not delete your account or practice history. Account deletion is separate and does not substitute for canceling renewal: cancel first, or contact us to help with both requests.
7. Refunds
Digital practice access is delivered after payment, so purchases and renewals are generally non-refundable once access is activated, except as follows:
- Duplicate charges: we provide a full refund of the duplicate charge.
- Non-delivery: if we cannot activate purchased access within 72 hours of successful payment, we provide a full refund.
- Extended outage: if an outage caused by us prevents use of purchased access for more than 72 consecutive hours, you may choose an extension or a pro-rata refund for the affected time.
- Service closure: if we end active paid access for reasons unrelated to your breach, we refund the unused prepaid time on a pro-rata basis.
- Mandatory rights: any non-waivable cancellation, withdrawal, refund, or other consumer rights under applicable law remain unaffected.
We do not offer a voluntary seven-day money-back guarantee. Disappointment with an estimated score, unused access, or forgetting to cancel does not itself qualify for a refund. Access suspended for a breach does not qualify for a voluntary refund, without affecting mandatory rights.
Email support@toeflscorer.com with your account email, transaction reference, and reason. Do not send card details. We aim to reply within 2 business days and resolve confirmed billing errors within 5 business days. Approved refunds go through Waffo Pancake to the original payment method; bank processing times vary. A processed refund revokes access associated with the refunded purchase, including for a partial refund; we explain the access effect when arranging an outage remedy. Any separate valid purchase remains subject to its own term.
8. Billing disputes
Please contact support@toeflscorer.com promptly about an incorrect charge so we can investigate. This request does not remove your right to contact your bank, use a dispute process, or meet an applicable dispute deadline.
9. Your content and intellectual property
You retain your rights in submitted answers and recordings. You grant us a limited, non-exclusive license to process, store, transmit to evaluation providers, and display that content only as necessary to provide and secure the Service and your requested feedback. We do not use your answers or recordings to train AI models. We do not grant ourselves a general right to distribute your recordings or answers publicly.
To the extent permitted by law and third-party rights, you may retain and use the feedback generated for you for your own study. AI output may not be unique or eligible for exclusive intellectual property protection. Our original questions, site content, code, and design remain ours or our licensors'. Buying access does not authorize copying or reselling the question bank.
10. Acceptable use
Use the Service for lawful practice. You must not submit unlawful, fraudulent, abusive, defamatory, infringing, or privacy-violating material; sexual content involving minors; malware or phishing; or content impersonating another person deceptively. Do not use the Service to create deceptive deepfakes, misrepresent AI feedback as an official ETS result, or facilitate cheating on an actual examination.
Do not bypass payment, scoring limits, authentication, or security controls; scrape questions or systematically extract outputs; resell access; disrupt the Service; or use its questions, outputs, or responses to train, distill, or develop competing AI models without permission. Do not present automated feedback as professional advice. Applicable laws and payment-network rules must be respected.
11. Privacy and security
Our Privacy Policy explains account information, recordings, answers, evaluation providers, retention, and your rights. Score-summary share links can be viewed by anyone holding the link; they do not expose detailed answers or recordings. Share only when you intend that visibility. Protect your account and device.
12. Disclaimers and liability
Except where law requires otherwise, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free AI feedback, or a particular test outcome. Nothing here limits mandatory consumer guarantees.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive losses, or lost profits or opportunities. Our total liability arising from the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. This does not exclude liability that cannot lawfully be limited.
13. Suspension and termination
We may suspend or terminate access for a material breach, fraud, security risks, or legal requirements. Where appropriate, we will explain the reason and allow correction. If we discontinue paid service for reasons unrelated to your breach, Section 7 applies. You may request account and history deletion using the contact below or delete your account in account settings; cancel any subscription first.
14. Disputes and applicable law
Please contact us first to give us a reasonable opportunity to resolve a dispute. These Terms are governed by the laws applicable where the individual operator is established, subject to mandatory consumer protections and rights to bring a claim in your home jurisdiction. These Terms do not impose mandatory arbitration.
15. Changes and general provisions
We will publish revisions with a version and effective date. Material changes will be announced on the site or by account email at least 14 days before taking effect, unless an earlier change is required by law or urgent security needs. Changes apply prospectively; mandatory rights are preserved. If you disagree, stop using the Service and cancel future renewals.
These Terms and the Privacy Policy form the agreement for the Service. If a provision is unenforceable, the rest remain effective. Not enforcing a provision is not a waiver. English and Chinese versions describe the same policy; where interpretations differ, mandatory local consumer protections prevail.
